Terms of Service
Last updated 2026-10-09
Effective date: 2026-10-09
1. About these Terms
These Terms of Service ("Terms") are an agreement between 846155 Yukon Inc., operating as North60 Consulting ("North60", "we", "us"), and the business or organization that creates a WaiverNorth account ("Customer", "you"). They apply to WaiverNorth, including the website at waivernorth.com, the console, signing pages, the kiosk app, the API and related services (together, the "Service").
By creating an account or using the Service, you accept these Terms. The person who accepts them confirms that they are authorized to bind the Customer. The Service is for businesses and organizations. It is not offered to consumers for personal use.
2. The Service
2.1 WaiverNorth lets you publish liability waivers and related forms, collect signatures from your guests and participants ("Guests") online and on kiosks, and store, search and export the signed records.
2.2 We may improve and change the Service. We will not materially reduce the core features of a paid plan during a period you have already paid for, and we will give you at least 30 days' notice of any material reduction.
2.3 Kiosks can collect waivers without an internet connection. Records signed offline are kept on the device until it reconnects and are uploaded automatically. We are not responsible for records lost because a device was lost, damaged or reset, or its browser data was cleared, before the records were uploaded.
3. Your responsibilities
3.1 Waiver content. You are solely responsible for the wording of your waivers and forms, for their legal validity and enforceability, and for how and when you present them to Guests. WaiverNorth does not provide legal advice and does not review your content. We recommend that a lawyer in each province or territory where you operate reviews your waivers.
3.2 What We Do. We store each published version of your waiver unchanged, record what each Guest was shown and signed, when and on which device, and preserve the signed record, so that you can show what was published and signed.
3.3 Minors. You decide the age of majority, minimum age and guardian requirements for each waiver, and you are responsible for these settings and for checking age or identity where needed. Note that certain jurisdictions do not allow minors to waive their rights to seek damages or sue.
3.4 Lawful Collection. You are responsible for having the right to collect the information your forms ask for, including photos, answers to health or safety questions and marketing consent, and for any notice to Guests that your own privacy obligations require.
3.5 Accounts and Devices. You must keep sign-in details confidential, manage your staff's access and your kiosks, and disconnect lost or stolen devices promptly. Administrators must use two-step verification. You are responsible for activity under your account.
4. Acceptable use
You must not use the Service to break any law, send unsolicited messages, collect information you are not entitled to, infringe anyone's rights, access another customer's data, test or probe the security of the Service without our written permission, copy or reverse engineer the Service except where the law allows it, or place an unreasonable load on it. We may suspend access that puts the Service, other customers or Guests at risk, and will tell you why as soon as we reasonably can.
5. Plans, fees and taxes
5.1 Plans, prices and limits are those shown on our pricing page when you subscribe. Prices are in Canadian dollars, plus applicable taxes (GST/HST, and PST or QST where they apply).
5.2 New accounts receive a 30-day free trial. At the end of the trial you can choose a plan. If you do not choose a plan, new signings stop when the trial ends and your account becomes read-only. We send reminders 7 days and 1 day before your data is deleted. 30 days after the trial ends, the account and all its data, including waivers signed during the trial, are permanently deleted. Export any records you need before then.
5.3 Plans are billed in advance, monthly or annually, through our payment processor. Annual plans are paid for the full year at a 15% discount.
5.4 We notify your administrators when you reach 80% and 100% of your monthly waivers. Signing continues up to 120% of the limit at no extra charge. Beyond that, new online signings pause until you upgrade or the next month starts in your time zone. Waivers from kiosks and forms opened before the pause are still accepted. We do not charge overage fees.
5.5 We will give at least 30 days' notice of any price change. A new price applies from your next billing period.
5.6 Monthly plans can be cancelled at any time, effective at the end of the current month, and partial months are not refunded. Annual plans are not refundable, except as stated in section 15.
5.7 If a payment is more than 14 days overdue, we may pause new signings until it is paid. Your existing records remain available to view and export.
6. Your data
6.1 Ownership. You own the content you upload and the information collected from your Guests, including signed records ("Customer Data"). You allow us to host, process, transmit and display Customer Data only to provide, secure and support the Service, and as required by law.
6.2 Our Role. For Guest information we act as your service provider. We process it on your behalf and according to your instructions, as described in our Privacy Policy. You remain responsible for Guest information under the privacy laws that apply to you.
6.3 Location. Signed waivers, signatures, photos and attachments are stored in Canada. Some of our service providers process limited information outside Canada, as listed in our Privacy Policy.
6.4 Retention. Signed waivers are legal records. We keep each signed waiver for the retention period set for your account and protect it against change and deletion during that period, both while you are a customer and afterwards, so that it is available if a claim arises. The retention period is 7 years after signing unless you choose a different period, including permanent retention. Because of this protection, a record cannot be deleted before its retention period ends, even on request. If you tell us that a record is needed for a claim, we keep it until you tell us the claim is resolved. After the retention period ends, the record is deleted within 90 days. Waivers signed during a free trial are handled as described in section 5.2.
6.5 Export. You can export your records (CSV and PDF) at any time, including after cancellation for at least 90 days through the console, and afterwards on request.
6.6 Imported Records. If you import records from another provider, we store them as provided, including the original documents, and mark them as imported. We do not check their content or validity. At your request, we can run the import for you using access you give us, such as an API key, which we delete once the import is complete.
6.7 Security and Incidents. We protect Customer Data with safeguards suited to its sensitivity, as described in our Privacy Policy. If we become aware of a breach of security safeguards affecting your Customer Data, we will tell you without undue delay and help you meet your own notification obligations.
6.8 Commitment to Data. We do not sell Customer Data and do not use Guest information for our own marketing. We may use counts and other information that does not identify anyone to operate and improve the Service.
6.9 Support Access. Our staff may view your records in read-only form when this is needed to provide support or to investigate a problem. Each access is recorded with its reason and appears in your account's activity history.
7. Confidentiality
Each party will keep the other's non-public information confidential, use it only for this agreement, and protect it with reasonable care. This does not apply to information that is public through no fault of the receiving party, already known to it, or independently developed, or that must be disclosed by law.
8. Intellectual property
We own the Service and everything we provide as part of it. You keep all rights in your content, names and logos, and allow us to display them on your signing pages, kiosks, emails and PDFs. If you send us suggestions, we may use them without obligation to you.
9. Other services
Payments are handled by our payment processor under its own terms. If you connect other systems to the Service through our API or webhooks, you are responsible for those systems and for the information you send to them.
10. Availability and support
We use reasonable efforts to keep the Service available, apart from planned maintenance, which we try to schedule at quiet times, and events outside our reasonable control. Support is available by email at hello@waivernorth.com and through the Help form in the console.
11. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available". We do not promise that the Service will be uninterrupted or error free, or that any waiver collected through it will be enforceable. Whether a waiver protects you depends on its wording, how it was presented and the law that applies, which are your responsibility.
12. Your indemnity
You will defend and indemnify North60 against claims by third parties, including Guests, arising from your waiver content, your activities, tours or services, your use of the Service in breach of these Terms, or your breach of law, and pay resulting costs, damages and reasonable legal fees.
13. Limitation of liability
13.1 Neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or goodwill.
13.2 Each party's total liability under these Terms is limited to the fees you paid in the 12 months before the event giving rise to the claim.
13.3 These limits do not apply to your payment obligations, your indemnity in section 12, a party's fraud, gross negligence or wilful misconduct, or where the law does not allow them.
14. Term, suspension and termination
14.1 Your plan renews automatically for the same period until cancelled. You can cancel in the console at any time, effective at the end of the current billing period.
14.2 Either party may end this agreement if the other materially breaches it and does not fix the breach within 30 days of written notice. We may suspend or end access immediately for serious misuse that puts the Service, other customers or Guests at risk.
14.3 When this agreement ends, collection of new waivers stops. Your records remain stored and exportable as described in sections 6.4 and 6.5. Sections 6, 7, 11, 12, 13, 15 and 16 continue to apply.
15. Changes to these Terms
We may update these Terms. We will give at least 30 days' notice of material changes by email to your administrators and in the console. The updated Terms apply from the date stated. If you do not agree, you may cancel before that date and receive a pro-rated refund of any prepaid annual fee.
16. Governing law and disputes
These Terms are governed by the laws of Yukon and the federal laws of Canada that apply there. The parties will first try to resolve any dispute in good faith. Otherwise, the courts of Yukon have exclusive jurisdiction.
